To help us provide you with the very best services and avoid confusion and misunderstandings, we ask that you read the Terms & Conditions (the "Terms") below carefully prior to making any bookings or reservations with us. By booking, making a deposit or payment towards, or participating in any travel product or service with After Hours Travel ("After Hours Travel," “AHT,” “I,” "we," or "us"), you agree to the Terms that apply to that package in effect at the time of your booking. These Terms are and represent a legally binding contract.
By making travel bookings on our website or with one of our agents, or otherwise purchasing any travel services offered by After Hours Travel, you warrant that:
BOOKING ON BEHALF OF OTHERS
If you make a booking for anyone other than yourself, you are considered the designated/primary contact person for those other travelers. You represent and warrant that you are legally authorized to act on their behalf; that you have obtained all required consents; and that you will inform them of these Terms and warrant that they accept and agree to them. You are also responsible for making all payments due for your booking, notifying us if any changes or cancellations are required, and keeping the other travelers informed of all information relevant to your trip.
TRAVEL AGENT
After Hours Travel is not the source or supplier of travel services I have requested, and acts as an agent for the actual suppliers of such services only. We sell various travel-related products on behalf of numerous transport and accommodation service providers, including, but not limited to, airlines, coaches, rail, cruise line operators, and hotels. After Hours Travel does not own, operate, manage, or control these independent suppliers of services and is not liable for their acts or omissions. The Independent Associate’s obligations to you are to make travel bookings on your behalf and to arrange relevant contracts between you and the travel service providers. We have no responsibility for these services, nor do we have the authority to make any warranty or representation regarding their standard. A request cannot be guaranteed. All bookings are subject to the terms and conditions and limitations of liability imposed by these travel service providers. You understand that your legal recourse is against the specific provider, not After Hours Travel.
IMPORTANT CONDITIONS
Prices are subject to increase prior to the time you make full payment. Prices are not subject to increase after you make full payment, except for charges resulting from increases in government-imposed taxes or fees. By signing below, you expressly acknowledge your acceptance of these conditions (i.e., increases before full payment and increases attributable to government-imposed taxes or fees after full payment will be your responsibility) applicable to your purchase. If there is an obvious error and you have made a booking, we will offer you the opportunity to keep your booking by paying the correct price or we will cancel your booking without penalty.
DEPOSIT AND FINAL PAYMENT
You will be required to pay a minimum deposit of USD$100 per person when booking. The service provider may require further deposits. All deposits are non-refundable. Final payment is required no less than 60 days prior to departure unless otherwise stated. Some airfares or services must be paid in full at the time of booking.
CONFIRMATION
After we receive your booking and deposit, we will confirm availability of all components and send you a confirmation email within 1–2 business days. If any option or component you selected is not available, we will alert you and give you the option to modify your booking or to cancel and receive a refund of your deposit.

ADDITIONAL FEES
Additional taxes and surcharges that cannot be pre-collected may be charged locally by car rental agencies, hotels, or other suppliers. Most properties and vehicle rental/leasing companies require a credit card imprint at check-in.
CANCELLATION OR CHANGES (BY YOU)
Cancellations or changes (with respect to the travel date, destination, place where the trip starts, property or means of transport) to a booking can be made by contacting us. Bookings requested via electronic mail (email) are binding until you have received direct confirmation from one of our agents, and payment of any deposits or other charges are made in full.
You do not have an automatic right to cancel or change a booking unless allowed by the relevant Travel Provider under their Rules and Restrictions (which are provided to you before you make a booking).
Travel Providers may charge you fees for cancelling (in full or part) or changing a booking. Such fees will be set out in the Rules and Restrictions. You agree to pay any charges that you incur. Please be aware that for changes, the price of your new arrangements will be based on the applicable price at the time you ask us to make the change. This price may not be the same as when you originally booked the Travel Services. Prices tend to increase the closer to the departure date that the change is made.
Please read the relevant Rules and Restrictions, so you know which terms apply to your booking. For example (these are not exhaustive):
If you want to cancel or change any part of a booking and such cancellation or change is allowed by the relevant Travel Provider, then, in addition to any charges imposed by the Travel Provider, we may also charge you a cancellation fee. If such an administration fee applies, it will be notified to you before you agree to proceed with the change/cancellation.
Requests to modify an existing booking to change any component of your travel package, including but not limited to changes to departure date/location, return date/location, itinerary changes, passenger information, etc., are subject to the availability of the new fare, package, port, departure, etc. Such changes are subject to fees, which will be invoiced. When requests are received on or before your final payment due date, the change fees schedule below applies. When such requests are received after your final payment due date, they are considered cancellations and are subject to cancellation fees, but any refund due to you after such fees may be applied as a credit towards the new package or departure, or refunded by the travel provider.

Please be aware that many travel bookings are non-refundable, in whole or in part, and cancelled bookings will incur charges. These charges can be up to 100% of the cost of the booking, regardless of whether travel has commenced. Where we incur any liability for a cancellation fee or charge for any booking which you cancel, you agree to indemnify us for the amount of that fee or charge.
CANCELLATIONS (BY US/TRAVEL PROVIDERS)
We (and the relevant Travel Provider) may cancel your booking if full payment for the booking, you fail to provide required information in a timely manner, you fail to comply with any applicable requirements (such as terms & conditions, application for or receipt of visas, etc.) or any applicable cancellation/change charge or fee relating to a booking, is not received when due.
For a variety of reasons (such as a property is overbooked due to connectivity issues or a property is closed due to a hurricane, etc.), it is possible that a booking may be cancelled or changed by the Travel Provider or us. If this happens, we will make reasonable efforts to notify you as soon as possible and offer alternative options/assistance where possible or a refund.
CANCELLATION FEES
In the event of cancellation, we charge a cancellation fee equal to 10% of the total package price to compensate for services performed, including the booking of the trip, processing the cancellation of the trip, and assistance with making a claim with any purchased travel insurance. The minimum cancellation fee is $50 per person. We are not responsible for any incidental expenses or consequential losses that you incur as a result of a cancelled booking, including but not limited to loss of earnings, loss of enjoyment, or the cost of any connecting flights, accommodations, airport transportation, visas, document fees, vaccinations, or other services you may purchase that are dependent upon the operation of your trip.
CREDIT CARD TRANSACTIONS
With the exception of planning, change, cancellation, and other fees charged directly by After Hours Travel, any payments authorized by you will be processed by the travel service provider directly.
If for any reason, any travel service provider is unable to provide the services for which you have contracted, your remedy lies against the provider, and not against After Hours Travel and in the event that payment has been made to After Hours Travel by credit card, you agree that you will not seek to chargeback your payment to After Hours Travel. If the credit card is passed through to the travel services provider and you seek to chargeback your payment from the provider, you agree to be held liable and indemnify After Hours Travel against this chargeback from the provider, including without limitation any air debit memos charged to After Hours Travel. If After Hours Travel incurs any costs, including but not limited to attorneys’ fees to recover any payments charged back by your credit card company, you agree that you will be liable for these costs. If the credit card is declined, you guarantee that you will settle any amounts owing to After Hours Travel immediately.
FEES CHARGED BY BANKS
Some banks and card issuers impose fees for international or cross-border transactions. For example, if you make a booking using a card issued in a different country from the Travel Provider’s location or you choose to transact in a currency that is different from the local currency of our Service, your card issuer may charge you an international or cross-border transaction fee.
Also, some banks and card issuers impose fees for currency conversion. For example, if you make a booking in a currency different to the currency of your credit card, your card issuer may convert the booking amount to the currency of your credit card and charge you a conversion fee.
If you have any questions about these fees or the exchange rate applied to your booking, please contact your bank or card issuer. Our Group of Companies is not associated or responsible for any fees relating to varying exchange rates and, card issuer fees.
CURRENCY CONVERSION
Any currency conversion rates displayed on our Service are based on public sources and current exchange rates, which may vary between the time a booking is made and the time of travel. Such rates are provided for information purposes only, and while we seek to provide information that is correct, our Group of Companies does not guarantee the accuracy of such conversion rates because they are not within our control.
REFUNDS
Any refunds will be provided in accordance with the terms and requirements of the provider of the original booking. Such refunds will be made by the party that took your original payment. We do not have visibility or control of a Travel Provider’s refund process. Our fees are not refundable unless this is stated otherwise during the booking process. In the event you have an unpaid balance due to us, you agree that we may attempt to direct any refund to us, and will return any excess funds to you via check to the address we have on file, following a 10-business-day hold to allow funds to clear.
TRAVEL PROTECTION/INSURANCE
For your protection, we strongly recommend that you purchase trip cancellation and travel accident insurance that covers the consequences of cancellation and certain risks (such as the cost of repatriation in the event of an accident or illness). You are responsible for ensuring that any insurance policy taken out adequately covers your requirements. You may be shown certain travel insurance products from the travel provider or insurance companies with which we may have a relationship. Purchase of the plan is not required to purchase any other travel product or service. We act only as a sales agent for the insurance provider(s), and questions about coverage or claims should be directed to the insurance provider. You may purchase your coverage from the provider of your choice, whether through us or not. Please be aware that certain coverages may be contingent upon purchase within a certain period of time after your initial deposit. After Hours Travel is not an insurance company and has no responsibility for the submission, payment, or adjustment of any insurance claims. Any insurance claims that may fall under the relevant travel insurance policy must be submitted to the insurance company identified in the policy.
PASSPORTS
All individuals departing from the United States of America must be in possession of a valid passport. Please check that your passport is valid for a minimum of 6 months or longer than your intended travel time. Some countries also require a specific number of blank visa pages in your passport. It is your responsibility to ensure that you have valid travel documentation, including but not limited to passports and visas, which meet the requirements of immigration and other government authorities at every destination. You are responsible for confirming with the United States Department of State or the representative government agency of the country to which you are traveling to confirm the requirements for visas and/or other requirements for admission to your destination. Any fines, penalties, payments, or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be your sole responsibility. A valid government-issued ID is required for travel within the USA; however, depending on the State of departure or arrival, a passport may be required instead of a driver’s license.
TRAVEL DOCUMENTS
Travel documents, including, without limitation, airline tickets, hotel vouchers, tour vouchers, or any other document (whether in electronic form or otherwise) used to confirm an arrangement with a service provider. Travel Documents may be subject to certain conditions and/or restrictions, such as, but not limited to, being non-refundable, non-date-changeable, and subject to cancellation and/or amendment fees. Travel documents cannot be transferred to another person to use. All airline tickets must be issued in the name of the passport/photo identity holder. An incorrect name on a booking may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates, and timings may result in an inability to use that booking and the booking being cancelled. Any errors in names, dates, and timings on your documentation will be your responsibility if not advised at the time of booking. Please reconfirm your flights at least 24 hours prior to departure.
ENTRY & EXIT FEES
Some countries, airports, or ports may require the payment of entry or exit fees, border crossing fees, or other taxes or fees upon arrival or departure, which must be paid directly by the traveler and cannot be included in our package prices. You are responsible for payment of these fees. In some cases, these may be paid by credit card, but others may only be payable in U.S. or local currency. We do our best to inform you of such fees when you book and/or prior to travel, but we are not responsible for omissions or errors.
HEALTH AND SPECIAL REQUIREMENTS
It is your responsibility to ensure you are aware of any health, insurance, and/or vaccination requirements for your travel destinations and to ensure that you carry all necessary documentation.
INTERNATIONAL FLIGHTS
Some countries require insecticide spraying of aircraft prior to a flight or while you are on the aircraft. Federal law requires that we refer you to the Department of Transport disinfection website. (http://airconsumer.dot.gov/spray.htm)
LOYALTY/FREQUENT FLYER/MILEAGE PROGRAMS
If you provide it, we will enter your loyalty, "frequent flyer" or mileage award program account number into your flight record, hotel, or other booking when making the reservation. When you check in for your transportation or accommodations, confirm that your account number has been added. Please note, the flights or hotels offered in our packages may not be eligible for these programs due to vendor requirements or rate types. Please contact the respective loyalty program if you have questions about eligibility or the crediting of points or miles to your account.
If receiving points for your stay/reservation/flight is important to you, we can provide a quote for point-eligible rates.
ACCEPTANCE OF RISK
You acknowledge that travel, especially to foreign and remote destinations, may involve some risk to your health and safety. The degree and nature of personal risk involved depend on the products or services booked and the location(s) in which a product or service operates. There may be a significant degree of personal risk involved in participating in physical and/or high-risk activities (such as ziplining, snorkeling, or hot air balloon rides), carriage by watercraft, or traveling to high altitudes, remote locations, or countries with developing infrastructure. Standards of hygiene, accommodation, and transport in certain destinations we visit are often lower than the standards you may expect in your home country, and there may be a risk of food poisoning, disease, or injury.
By booking with us, you acknowledge that you have considered the potential risks, dangers, and challenges, and your own personal capabilities and needs, and you assume responsibility for all such risks. You agree to take all prudent measures in relation to your own safety while traveling, including but not limited to the proper use of safety devices (including seatbelts, harnesses, flotation devices, and helmets) and obeying all posted signs and oral or written warnings regarding health and safety. After Hours Travel and our representatives will not be held liable for any claims or causes of action arising from any losses, damages, injuries, or death resulting from failure to comply with safety instructions or warnings or the risks inherent in travel and participating in adventurous activities booked by us, or otherwise offered or suggested by us or our representatives.
RESPONSIBILITY FOR TRAVEL PROVIDERS
We always do our best to make sure your travel arrangements are satisfactory. However, After Hours Travel, Independent Associates and its employees, shareholders, subsidiaries, affiliates, officers, directors, successors, agents, and assigns do not own or operate any entity which provides goods and services for your travel including without limitation, lodging facilities, airline, vessel, motor coach, or other transportation companies, guides or guide services, local ground operators, providers or organizers of optional excursions, food service providers, etc. All such persons and entities are independent providers and/or contractors and are in no way affiliated with After Hours Travel.
LIABILITY
After Hours Travel is not liable for any negligent or willful act or failure to act of any travel service provider or of any third party. In addition and without limitation, After Hours Travel is not responsible for any injury, loss, death, inconvenience, delay, or damage to person or property in connection with the provision of any goods or services whether resulting from, but not limited to, acts of God or force majeure, illness, disease, acts of war or civil unrest, insurrection or revolt, animals, strikes or other labor activities, criminal or terrorist activities of any kind, overbooking or downgrading of accommodations, mechanical or other failure of airplanes or other means of transportation, or for any failure of any transportation mechanism to arrive or depart on time. Also, be advised that certain foreign facilities, such as air-conditioning systems in public places, hotels, and motor coaches, may not be up to U.S. standards. If due to weather, flight schedules, or other uncontrollable factors, you are required to spend additional night(s), you will be responsible for your own hotel, transfers, and meal costs. Baggage is entirely at the owner's risk. You may see the name After Hours Travel or Travel Co. affixed to motor vehicles, on signs around the hotel, or elsewhere. This use of our name is purely for reasons of identification and does not denote ownership, supervision, or control by After Hours Travel in any way. The prices of these tours are based on rates in effect (including foreign exchange rates) at the time of printing and are subject to change without notice. Under circumstances where liability cannot be excluded, such liability is limited to the value of the purchased travel arrangements. You specifically agree that After Hours Travel is not liable for any consequential loss or damage.
To the maximum extent permitted by law and subject to the limitations in these Terms, we will not be liable for any direct, indirect, punitive, special, incidental or consequential losses or damages arising from, the Travel Providers, the use of our services, any delay or inability to use our services, or your use of links from our Service, whether based in negligence, contract, tort, strict liability, consumer protection statutes, or otherwise, and even if we have been advised of the possibility of such damages.
If we are found liable for any loss or damage under these Terms, then, subject to the exceptions and limitations in these Terms and to the maximum extent permitted by law, we shall only be liable to you for direct damages that were reasonably foreseeable by both you and us, actually suffered or incurred by you, and directly attributable to our actions, and in the event of any liability of ours, such liability will in no event exceed, in total, the greater of (a) the cost paid by you for the Travel Services in question or (b) one-hundred dollars (US$100.00) or the equivalent in local currency.
This limitation of liability reflects the allocation of risk between you and us. The limitations specified in these Terms will survive and apply even if any limited remedy specified in these Terms is found to have failed its essential purpose. The limitations of liability provided in these Terms inure to the benefit of us.
INDEMNITY
You agree to fully compensate us, our employees, and other people officially acting on our behalf, for any damages, losses, fines, costs or expenses (including reasonable legal and accounting fees), of any kind (“Losses”) that they incur or are liable for as a result of a claim being alleged or brought against them by a third party because of your breach of these Terms or the documents referenced in them, your violation of any law or the rights of a third-party, your use of our services, or the Travel Services booked through us, and/or any Content you provide or submit in connection with our services, but only to the extent that the Losses are not directly caused by our actions.
You will cooperate as fully as reasonably required if we are defending a claim.
We reserve the right to defend and take full control of any matter or claim that you are fully compensating us (and our employees, and other people officially acting on our behalf) in respect of, and you agree not to settle any matter or claim without our written consent.
We will promptly provide notice to you of any such claims.
RELEASE
If you have a dispute with one or more Travel Providers (including any dispute regarding any booking, transaction or Content) or any third-party provider, or any third-party website that may be linked to or from or otherwise interact with our Service, you agree that you will not involve, hold liable, or make any claim against, (including for Losses or compensation), us, our employees, and other people officially acting on our behalf, in any way in respect of the dispute. This paragraph will not apply to the extent that any such dispute is directly caused by us.
If you are a California resident, you waive California civil code section 1542, which says: “a general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which, if known by him must have materially affected his settlement with the debtor”.
REQUIRED INFORMATION
To make a booking, we require that you supply certain personal information, including the full legal name, gender, birthdate, and passport information for each traveler, as required by law and/or reasonably required to enable us and our suppliers to provide your purchased travel products and services. We also require contact information, including address, phone number, and email address, from the person making the booking. We request a phone number and email address for all other travelers, except for minors and family members who live together at the same address, so that we may reach you and your travel companions in case of last-minute itinerary changes or emergencies. For each traveler, we also require the name and contact information of a designated emergency contact person who is not traveling. You are responsible for verifying that any information you provide for yourself and on behalf of other travelers on your booking is complete and accurate. Under no circumstances will we be liable for any errors or omissions in the information you have provided to us, or any fees or damages related to such errors or omissions.
GOVERNING LAW
The construction, validity, and performance of these Terms and any disputes between the parties shall be governed by and construed according to the laws of the Commonwealth of Massachusetts, without giving effect to its conflicts of law principles, and any federal laws applicable therein. Both parties submit to the exclusive jurisdiction of the courts of the Commonwealth of Massachusetts with respect to any legal proceedings relating to these terms.
FAILURE TO INVOKE
Our failure or delay to enforce any provision of these Terms does not waive our right to enforce the same or any other provision(s) of these Terms in the future.
UNENFORCEABLE PROVISIONS
If any provision (or part provision) of these Terms is found by a court or other authority of competent jurisdiction to be invalid, illegal or unenforceable, that provision (or part provision) shall, if required, be deemed not to form part of these Terms with you. In such a case, the validity and enforceability of the other provisions shall not be affected.
ASSIGNMENT
We may, and you may not, assign, subcontract, or delegate rights, duties, or obligations under these Terms. However, we will not do so in such a way as to reduce any rights or guarantees you have under these Terms.
SURVIVAL OF OBLIGATIONS
Any provision of these Terms, which expressly, or by its nature, imposes obligations beyond the expiration or termination of these Terms, shall survive such expiration or termination.
ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and us with respect to our Service. They supersede all prior or contemporaneous communications (whether electronic, oral, or written) between you and us about our Service.

By making any payment on this invoice (partial or in full), I acknowledge that I have read, understand, and agree to the information, terms, and conditions set out above.
